Obtaining Petroleum Products Haulage Permit for transportation of produce

Petroleum Products Haulage is the transportation of petroleum and derivatives such as gasoline (petrol). Petroleum is transported via rail cars, trucks, tanker vessels, and through pipelines. Whichever method is used to move this oil depends on the amount that is being moved and its destination. 


PERMITS ISSUED BY DPR

Transportation is an important aspect in the distribution of petroleum products and a Petroleum Products Haulage Permit is required for these activities to be carried out in Nigeria. The production centers are usually far from consuming areas. A large proportion of the world’s refineries are located far from the market. The fluidity of most of the petroleum products makes it amendable to transportation by any agency capable of removing a liquid from one place to another by trucks, railroads, ships and pipeline.


PETROLEUM PRODUCTS HAULAGE PERMIT

The biggest problems with moving this oil are pollution and the chance of being spilled or causing accidents, therefore the need to properly regulate the movement and ensure that only licensed business owners are permitted to transport. 


DEPARTMENT OF PETROLEUM RESOURCES (DPR) 

This is the agency that regulates and licenses companies in the business of petroleum products haulage. For the purpose of obtaining permits from the DPR, there are three categories under which a company can apply under:

  1. General purpose category;

  2. Major category; and

  3. Specialized category.


The Petroleum products haulage permit can be obtained under the Major Category; under the Major Category applicants are required to possess relevant and verifiable technical/special skills.

Transportation of petroleum products can be by via rail cars, trucks, tanker vessels, and through pipelines. Transportation by road is still a popular mode of transporting petroleum and petroleum produce in Nigeria.


DOCUMENTARY REQUIREMENTS FOR OBTAINING A PETROLEUM PRODUCTS HAULAGE PERMIT

The following documents are required during registration:

  1. Certificate of Incorporation;

  2. Certified True Copy of Memorandum & Articles Of Association;

  3. Certified True Copy of Form CAC 1.1 (Application form);

  4. Current Tax Clearance Certificate;

  5. Company’s Profile;

  6. Comprehensive Staff List & Curriculum Vitae of Key Staff (Should include Position & Qualification of Staff);

  7. List of Equipment/Facility available to the Company;

  8. List of approved Expatriate Quota position and their Nigerian understudies (where applicable);

  9. Proposed Training Programme for Nigerian staff for the current year;

  10. Registration by Relevant Professional Body;

  11. Technical Agreement or MOU with Nigerian company/DPR Accredited Laboratory (where applicable);

  12. Employee’s Compensation Scheme (Nigeria Social Insurance Trust Fund NSITF);

  13. Health, Safety, Environment And Community (HSEC);

  14. Current Medical Retainership Agreement with a Hospital Or Clinic located In Company’s Operational Location; and

  15. Letter of Accreditation (Laboratory Services)


Government Agencies and MDAs are excluded from these requirements


OBTAINING A PETROLEUM PRODUCT HAULAGE PERMIT FROM THE DPR 


STEP 1: 

Online Application: DPR application is done online on the DPR website, applicants are to provide correct and functional addresses, telephone numbers and e-mail at the time of submission to create a company account and fill in necessary details.


STEP 2:

Document Upload: All required documents stated above should be uploaded in PDF or JPEG format to the DPR portal. In addition, applicants are to attach certificates of membership of such Professional body and other relevant documents as may be applicable.


Applications with false or forged documents during verification, will be disqualified with applicant forfeiting the remitted fees and such applicant may be prosecuted by the DPR.


STEP 3:

Submission and Payment: Upon successful upload of all required documents, applicant may go ahead to make payment via electronic online platforms or at any available bank. The applicable fee for the petroleum products haulage permit under the major category is statutory fee of N25, 000 and processing fee of N2, 500.


STEP 4:

Processing of Application: Application will be processed within 72 hours after which successful applicants can print their permit(s) online.



INSPECTION BY THE DEPARTMENT OF PETROLEUM RESPORCES

The DPR would conduct inspection of the facilities for all new applicants prior to a consideration for the issuance of permits, hence companies must have physical presence in Nigeria. All applications will be subjected to further evaluation by relevant Divisions or Units in the DPR to assess their professional competencies and capabilities. Inspections are without notice and without prejudice to existing permits or approval.


VALIDITY OF DPR PERMIT

DPR permit is valid for a year hence renewal is to be done annually. An Applicant may apply for the renewal of his permit via the same portal with required documents and payment of statutory fees
